Lebon Consulting & MyBenefitz.

These Terms govern your access to and use of the financial services, digital platform, websites, applications, tools, products, and related services provided by Lebon Consulting and facilitated through MyBenefitz.

Introduction and acceptance

These Terms of Service (“Terms”) govern your access to and use of the financial services, digital platform, websites, applications, tools, products, and related services provided by Lebon Consulting (Pty) Ltd, an authorised Financial Services Provider with FSP number 52013.

Certain services, applications, transactions, client onboarding processes, and digital interactions may be facilitated through MyBenefitz, which operates as a digital platform and juristic representative of Lebon Consulting.

MyBenefitz

The digital platform, brand, and juristic representative.

You / Client

Any person who accesses our website, platform, application, services or digital channels.

By accessing or using www.mybenefitz.co.za, app.lebonconsulting.co.za, any Lebon Consulting website, MyBenefitz platform, mobile application, digital form, or related service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use our services.

Role of Lebon Consulting and MyBenefitz

Lebon Consulting is an authorised Financial Services Provider and is responsible for the provision of financial services where such services are rendered under its FSP licence.

MyBenefitz operates as a digital platform and juristic representative of Lebon Consulting. MyBenefitz may be used to:

Collect client information
Facilitate product applications
Enable digital onboarding
Submit applications to product providers
Communicate with clients
Facilitate premium or repayment instructions
Support policy & service administration
Provide access to value-added services
Manage digital client journeys

Any financial product, advice, intermediary service, or related financial service made available through MyBenefitz is provided under the authority, oversight, and FSP licence of Lebon Consulting, unless clearly stated otherwise.

Lebon Consulting, directly or through the MyBenefitz platform, may provide access to the following financial services and related products:

Life Insurance

Life insurance products through licensed insurers and product providers.

Funeral Cover

Funeral insurance products through licensed insurers and underwriting partners.

Health Insurance

Selected health insurance products including Flexicare, subject to product terms and underwriting.

Short-Term Insurance

Short-term insurance products through licensed insurers.

Investments

Selected investment products subject to risk disclosures, minimum requirements and fees.

Loans

Loan applications through accredited credit providers and lending partners.

Bond Origination

Home loan applications through accredited financial institutions and bond origination partners.

Credit Repair

Credit repair support, credit education, financial wellness tools and related assistance.

Insurance and financial products offered or facilitated through Lebon Consulting and/or MyBenefitz may be underwritten, administered, or provided by the following licensed product providers:

Product providers remain responsible for their respective policy contracts, benefit payments, claims decisions, underwriting, and product administration. Lebon Consulting and MyBenefitz do not underwrite insurance products unless expressly stated.

Eligibility for services

General eligibility

  • Be at least 18 years of age
  • Be legally capable of entering into binding agreements
  • Be a legal resident of South Africa (unless otherwise permitted)
  • Provide accurate, complete, and up-to-date information
  • Meet the specific product or service requirements
  • Comply with all applicable laws and regulatory requirements
  • Provide documentation for verification and onboarding
  • Comply with FICA, FAIS, NCA, POPIA and other legislation

Product-specific eligibility

Certain products may have additional eligibility criteria including:

  • Age limits
  • Employment or income requirements
  • Affordability assessments
  • Medical underwriting & waiting periods
  • Credit provider requirements
  • Residency & banking verification
  • Premium payment requirements
  • Provider-specific acceptance criteria

Approval is not guaranteed and remains subject to the relevant provider’s rules.

Credit repair and financial wellness services

Lebon Consulting and/or MyBenefitz may provide credit repair assistance, credit education, credit profile support, and financial wellness guidance to qualifying clients.

Services may include

  • Reviewing credit reports from SA credit bureaus
  • Identifying inaccuracies or outdated information
  • Preparing and submitting credit bureau disputes
  • Credit education and guidance
  • Helping understand credit score factors
  • Supporting communication with creditors
  • Financial wellness planning
  • Access to related tools and resources

Limitations

  • We do not guarantee removal of accurate negative information
  • We do not guarantee a specific credit score improvement
  • We do not make payments to creditors on your behalf
  • We do not act as a registered debt counsellor unless stated
  • Outcomes depend on credit bureaus, creditors and documentation
  • Accurate adverse information may remain for the period allowed by law
  • Credit repair support is provided on an "as is" basis

Credit repair assistance may be offered as a complimentary or value-added service to qualifying clients who have an active primary service relationship. We reserve the right to suspend or terminate this service if your qualifying product is cancelled, lapses, or falls into arrears.

Fees, premiums, payments and charges

Product fees & premiums

Fees, premiums, and charges will be disclosed in the relevant product documentation, quotation, policy schedule, or application process.

Insurance premiums

Must be paid in accordance with the policy terms. Failure may result in suspension, lapse, cancellation, or loss of benefits.

Loan repayments

Governed by the credit provider's credit agreement including interest rate, fees, repayment schedule, and default consequences.

Credit repair fees

Complimentary value-added services carry no direct fee. Any paid services will be disclosed before acceptance.

Client information, accuracy and consent

You agree that all information you provide through Lebon Consulting, MyBenefitz, our websites, application forms, digital tools, advisers, call centre, WhatsApp channels, or other communication channels must be accurate, complete, and up to date.

Complying with FICA and legal obligations

Assisting with claims, disputes or queries

Providing false, incomplete, or misleading information may result in declined applications, cancelled policies, rejected claims, termination of services, legal action, or regulatory reporting.

Privacy and data protection

Lebon Consulting and MyBenefitz process personal information in accordance with applicable South African laws, including POPIA, FICA, FAIS, PAIA, the NCA, and the CPA.

We do not sell your personal information. Full details of how we collect, use, and protect your data are set out in our Privacy Policy.

Financial advice, intermediary services and product responsibility

Where financial advice or intermediary services are provided, such services are provided under the FSP licence of Lebon Consulting, subject to the scope of authorisation and applicable laws.

  • Product information may be provided for comparison, education, or application purposes.
  • Product-specific terms are in the relevant policy documents, schedules, quotations, or credit agreements.
  • Product providers are responsible for their products, underwriting, claims, and benefits.
  • Advice must be considered together with your needs, affordability, and risk profile.
  • You should read all product documents carefully before accepting any product.

In the event of conflict between these Terms and a product provider’s official policy wording or product contract, the official product contract will prevail in relation to that product.

Cooling-off periods and cancellations

You may have the right to cancel certain policies or contracts within an applicable cooling-off period. For long-term insurance policies, this is typically 30 days from the date you receive the policy documents.

To exercise a cooling-off or cancellation right, notify us or the relevant product provider in writing within the applicable period. Refunds are subject to the relevant product terms, premiums used for risk cover, administration fees, and applicable legislation.

Claims, benefits and product administration

Claims, benefit payments, policy changes, cancellations, underwriting decisions, exclusions, and waiting periods are governed by the relevant product provider’s terms and conditions.

Lebon Consulting and MyBenefitz may assist you with claims submission and communication with providers, but final decisions regarding claims and benefits remain with the relevant product provider. You are responsible for submitting accurate claims information within applicable timeframes.

Platform use and digital transactions

The MyBenefitz platform may allow you to complete applications, submit documents, provide consent, sign forms, upload information, and transact digitally.

Digital forms, signatures, OTP approvals and electronic consents are valid
Electronic communications may be used for service and compliance
You are responsible for keeping login details and OTPs secure
You must not allow unauthorised persons to access your account
Notify us immediately if you suspect unauthorised access or fraud
Digital submissions using your credentials are treated as authorised

Prohibited activities

Zero tolerance

You agree not to use our services, websites, platforms, or communication channels for any unlawful, abusive, fraudulent, or prohibited purpose, including:

Providing false or misleading information
Submitting fraudulent applications or claims
Impersonating another person or entity
Violating any applicable law or regulation
Infringing intellectual property rights
Uploading malware or malicious content
Attempting unauthorised system access
Interfering with platform operations
Abusing staff, representatives or clients
Unlawfully manipulating credit repair or claims outcomes

Suspension and termination of services

We reserve the right to suspend, restrict, or terminate your access to our services where you breach these Terms, provide false information, fraud is detected, premiums are unpaid, or for any legitimate business or legal reason.

Termination of platform access does not automatically cancel any underlying policy, loan, investment, or product unless the relevant product terms provide for such cancellation.

Intellectual property

All content, trademarks, logos, graphics, designs, software, and materials made available through Lebon Consulting or MyBenefitz are owned by or licensed to Lebon Consulting, MyBenefitz, their affiliates, or licensors.

You may not copy, reproduce, modify, distribute, publish, or create derivative works without prior written consent. You may use our websites and platform only for lawful personal or authorised business purposes.

Disclaimers

Our services, websites, digital tools, and platform are provided on an “as is” and “as available” basis. To the fullest extent permitted by law:

  • We do not guarantee uninterrupted, error-free, or secure platform access.
  • We do not guarantee approval for any product application.
  • We do not guarantee any specific insurance, loan, investment, credit repair, or financial outcome.
  • We are not responsible for delays caused by third parties.
  • We are not liable for decisions made by insurers, lenders, or administrators.
  • Nothing in these Terms excludes liability that cannot be excluded under applicable law.

Limitation of liability

To the fullest extent permitted by law, Lebon Consulting, MyBenefitz, their directors, employees, representatives, and partners shall not be liable for any indirect, incidental, special, consequential, punitive, or economic loss arising from your use of or inability to use our services, declined applications, policy exclusions, credit repair outcomes, investment performance, unauthorised access, service interruptions, third-party acts, regulatory changes, force majeure, or any matter outside our reasonable control.

Where liability cannot be excluded, our liability will be limited to the extent permitted by applicable law.

Indemnification

You agree to indemnify and hold harmless Lebon Consulting, MyBenefitz, their directors, employees, representatives, product providers, and partners from any claims, losses, damages, penalties, or expenses arising from your use of our services, breach of these Terms, false information, violation of law, infringement of third-party rights, or unauthorised use of your account.

Complaints and regulatory escalation

If you have a complaint about our services, contact us using the details below. We will resolve complaints fairly, transparently, and within reasonable timeframes.

If unresolved, you may refer the matter to the relevant Ombud, regulator, or dispute resolution body.

Dispute resolution

Negotiation

Good faith negotiations between the parties.

Mediation

If unresolved after 30 days, either party may request mediation.

Arbitration

If unresolved after 60 days, arbitration in Pretoria under AFSA rules.

Nothing in this clause prevents either party from seeking urgent interim relief from a competent court.

Governing law

These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa. You consent to the jurisdiction of the courts of South Africa, subject to any applicable statutory dispute resolution process.

Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be severed and the remaining provisions will continue to apply.

Waiver

Failure by Lebon Consulting or MyBenefitz to enforce any provision does not constitute a waiver. Any waiver must be in writing and signed by an authorised representative.

Entire agreement

These Terms, together with our Privacy Policy, product disclosures, mandates, application forms, policy documents, credit agreements, and other applicable product-specific terms, constitute the agreement between you and Lebon Consulting and/or MyBenefitz.

Relationship of the parties

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Lebon Consulting or MyBenefitz. MyBenefitz acts as a juristic representative and digital platform of Lebon Consulting.

Changes to these terms

We may update or amend these Terms from time to time. Where material changes are made, we may notify you by posting updated Terms on our website, updating the “Last Updated” date, sending an email, issuing a platform notification, or using any other reasonable communication method.

Your continued use of our services after the effective date of updated Terms constitutes acceptance of the revised Terms.
